Privacy Notice

Policy:

The privacy practices of the Hospice, designed to protect the privacy, use and disclosure of protected health information, are clearly delineated in ELITE HEALTH CARE SYSTEMS’ Notice of Privacy Practices, which was developed and is used in accordance with Federal requirements.

Procedure:

The privacy practices and requirements are further detailed m the Protection, Use, and Disclosure of Health Information Section of this manual
The Notice of Privacy Practices is provided to patients / caregivers at the time of admission and upon request. At time of admission, Hospice will make a good faith effort to obtain from the patient or authorized representative an acknowledgement of receipt of Notice of Privacy Practices. If an acknowledgment cannot be obtained, the reasons for such inability shall be documented by the admitting staff. Once obtained, the acknowledgement will be placed in the patient’s medical record and retained for the same period as the entire medical record.
The Notice of Privacy Practices is reviewed with all current employees, volunteers annually, all new employees, and volunteers during their orientation.
The Notice of Privacy Practices is available to anyone who requests it. The Notice of Privacy Practices will be revised as needed to reflect any changes in this hospice’s privacy practices. Revisions to the Notice will not be implemented prior to the effective date of the revised Notice.
When revisions to the Notices of Privacy Practices are necessary, all current patients / caregivers, employees, volunteers and business associates will receive a revised copy with notation of the changes made.
The Privacy Officer retains copies of the original. Notices of Privacy Practices and any subsequent revisions for a period of six (6) years from the date of its creation or when it was last in effect, whichever is later. Documentation is retained for six years of the patient’s written acknowledgement of receipt of the hospice’s Notice of Privacy Practices or of efforts made to obtain this written acknowledgment and the reason(s) why it was not obtained.
All employees, volunteers and business associates are require to adhere to the privacy practices as detailed in the Notice ofPrivacy Practices, privacy policies and procedures and business associate contracts. Violations of these privacy practices will result in disciplinary action up to and including termination of employment or contracts.
The Notices of Privacy Practices is posted in a clear and prominent location at the hospice and on the hospice’s website.
